The terms “we,” “us,” or “our” refer to Propery-Intel Corp, DBA or PropertyHero. The term “you,” “customer,” or “user” refers to the customers, organization, visitors, or guests visiting our Website and or using our services or purchasing our goods or materials.

Upon registration to Propertyhero’s service, I as a representative of my company agree to all the terms set herein.

The goods and services provided by Propertyhero are supplied on an “as is” basis, we bear no liability for website downtime, unavailable due to server downtime, or slow service speed.

The software provided is created and sold for its intended purpose, and Propertyhero cannot be held responsible for use outside of their intended purposes.

We bear no liability, responsibility, or damages for the services we provide to you. The user agrees the software is to be used for purposes as intended. Providing you these materials does not constitute a contract in any manner by us. Further, you agree to indemnify us and our officers of all liabilities, responsibilities, and damages associated with the use of our services and materials.

Property-Intel will maintain a record of the information and data you provide to us. We do not assume responsibility for your data’s accuracy, or integrity, since you are the original data source.

We reserve the right to refund (or not refund) fees should we determine that services or reports were not accurate or otherwise deficient.

As a condition of your use of this Website, you warrant that:
1. You are at least 18 years of age;
2. You possess the legal authority to create a binding legal obligation;
3. You will use this Website following these “Terms of Use”;
5. You will use this Website following these “Terms of Service Providers”;
6. You will use this Website following the “Terms of Technology Use” available on the Website; and
7. You agree to the privacy policy terms of this Website.

If any part of these terms of services is found not legal or applicable in a court of law, it will not impact the other sections of the services’ enforceability.

Responsibility for the legitimate use of the software is yours. We reserve the right to revoke user privileges should we discover any misuse or attempts at reverse-engineering the product, including violation of service terms.

We do not share personal information with third parties for marketing purposes. We will not advertise services or products to you unless you are specifically opted-in to our benefits program. If you are opted-in, we will advertise directly to you, and you agree to be contacted based on any information you enter into the system. We will promote over our Website, email, SMS, browser push notification, or system messages. We will not advertise with phone calls. We may contact you on behalf of outside organizations but will not allow them to advertise to you directly. We will not sell “mailing lists” to outside organizations.

The information and data you entered into our system through the registration and account page is your property, and can be removed by you by contacting support. If you fail to pay your invoices or subscriptions that information will be held in suspense in order to reinstate your account at a time of your choosing.
Information you entered related to a user or property owner, is the property of that user, you have no rights to that information as it was provided as part of the services you provided to that user regardless if the user paid or did not pay for their services.

You have the right to delete your account at any time. If you would like a copy of your information, contact technical support before requesting deletion of the history.

The system creates a record of work done on items entered by the owner or service providers. These are independent records. Thus, we reserve the right to edit, modify, or delete owners or service provider records that are profane, abusive, bullying, or entered by a service provider seeking to manipulate the history of an item. Subscribers/customers who disagree with the records of a service provider entered into our system will have the right, within 48 hours of deleting your service notes. We would prefer not to modify records entered into our system without the direct permission of the person who entered those records. If this is not effective, the item’s owner or services provider should enter a support ticket explaining the reason for the change.

Our users and services providers drive our system; if they enter data incorrectly into our software, we are not liable or responsible for any error or damages that may result. Improper manipulation of service notes will be reviewed, edited, and deleted if found to be inaccurate. Continued abuse of the system may result in the termination of your account.

Company information provided by the service provider must be keep up-to-date and any changes can be made via the registered service provider modification page. Information may include: company name, phone numbers, email, license number, address, professional services. We are not liable for incorrect contact information or website addresses.

Propertyhero is provided on an “as available” basis. Although it is in our interest to be fully operational at all times, we do not guarantee uptimes or minimum performance requirements as a beta product. We will not be held liable for any loss of revenues, business, or damages that may occur due to system downtime. One of our services is to provide reminders to the users to perform specific actions. We are not liable if our system does not alert you with a reminder nor for any damages that may result because that reminder was not received or marked as a “junk” email. Propertyhero is not a service contractor. We offer the reminder service on an “as available” basis.

We reserve the right to charge fees for our service. Charges may be based in part on any factor like but not limited to, number of zip codes serviced, area of business, zipcodes serviced, size of business, number of transactions, number of clients services and so on.
Promotions are provided on an as available base and will be honored at the time they are issued to the service provider. Promotions can be changed or canceled at any time so it is best to take advantage of them as they exists. Free trials, promotions, coupons, points, and tokens are provided at our discretion and have associated terms which must be read and understood.

We are not liable or responsible for any error or damages resulting from lost or unsaved data. Our goal is to maintain your data, and we will improve the way we retain your data. If you discover that data is missing or inaccurate, please contact technical support and mark it as an urgent priority. We may retain data deleted by you. Retention of information by us is necessary due to the possibility that an item will “re-appear” at another property in the future.

Arbitration will be the first remedy for disagreements. If arbitration fails, legal jurisdiction will be in the Texas State Court System of the USA.

Payments will be invoiced to the service provider quarterly, and providers who signed up for reoccurring automatic payments will be automatically debited for their payment amounts. Providers will receive a receipt for their invoice over email, no mailed invoices or receipts will be received. Services are prepaid for the quarter that they are billed. We require credit card or bank payments and we cannot process or accept cash payments. Service providers who fail to prepay for services that quarter will have their accounts placed in suspense and will no longer be visible by subscriber/members.

If a provider cancels reoccurring payments, they will remain active on our system until the end of the quarter. If the provider requests immediate cancelation and refund, then their bill will be prorated for that quarter and their remaining balance will be refunded to them and their services will no longer be available on our system.

Users may provide ratings pertaining to your services, your service interactions with customers are the bases for these ratings, users may not rate provider who never provided service to them. Users must provide accurate ratings and be reasonable in their ratings. If you disagree with a user’s rating of your services, please contact support so we can moderate the rating interaction. We reserve the right to change or refuse to change ratings, and we may take more than 1 month to process service rating disputes.

You grant us the right to advertise and promote your business and services both publicly, on the web, over email, SMS, and other media and to our user base and to the general public. This right will extend as long as you pay for your services, and may exist beyond this time. You have the right to revoke our right to advertise your services, but that would also require us to remove you from our system.

We reserve the right to promote our services to you through emails, sms, and other media. These promotions may include but are not limited to: updates in our system, benefits and promotions, and change to user experience. Certain promotions you must receive, other related to external services provided by our partners or affiliates can be opted out of via your setting page. Further you agree to receive emails and SMS sent to you on behalf of the customer interaction.

You agree not to hold us liable for incorrect or inaccurate information entered by users or other service providers.

Per our terms of privacy, we will not share user information with you even if you provided prior services to that user. It is your responsibility to maintain a contact list with your customers. If the customer contacts you through our system their information and property or item information will then become available as they initiated the contact request. You agree not to share the information you enter into our system on behalf of a user with third-party provider or any other party at that information is the property of the user.

We will not get involved nor be liable for disputes between service providers and our users, as they are outside the privy of our system. The only way we will get involved is by modifying or removing the ratings or service notes provided by the user or service provider in regards to that dispute. We are in not way liable for the goods or services provided by that service provider to that user. Because service provider quality can change minute to minute, we are not liable for the ratings that we provide in our system and thus have no reasonability on the quality of service that service provider provide to there users.
